MIND Reviews: The Better Angels of Our Nature

The Better Angels of Our Nature: Why Violence Has Declined
by Steven Pinker. Viking Adult, 2011

According to the Stockholm International Peace Research Institute (SIPRI), worldwide military expenditures have been growing annually for the past 15 years, and between 15 and 20 major armed conflicts?yes, wars?are in progress as you read this. All told, upward of 175 million people died in war-related violence during the 20th century, plus another eight million because of conflicts among individuals.

Even so, according to this weighty new book by Harvard University psychologist Steven Pinker, the ?better angels? of human nature have actually brought about a dramatic reduction in violence during the past few millennia. Yes, the absolute number of victims has been rising, but relative to the world?s population, the numbers look good.

The shift toward nonviolence, he says, has been driven by many factors, such as the spread of agriculture and the rise of feminism and democracy. Such trends have led to a reduction in institutionalized torture and execution and slavery and, especially in recent years, to an increase in the rights of women, homosexuals, children and animals.

Pinker acknowledges that one?s immediate experience belies these facts to the point where you might even want to call him ?hallucinatory.? Yet the wealth of data he presents cannot be ignored?unless, that is, you take the same liberties as he sometimes does in his book. In two lengthy chapters, Pinker describes psychological processes that make us either violent or peaceful, respectively. Our dark side is driven by a evolution-based propensity toward predation and dominance. On the angelic side, we have, or at least can learn, some degree of self-control, which allows us to inhibit dark tendencies.

There is, however, another psychological process?confirmation bias?that Pinker sometimes succumbs to in his book. People pay more attention to facts that match their beliefs than those that undermine them. Pinker wants peace, and he also believes in his hypothesis; it is no surprise that he focuses more on facts that support his views than on those that do not. The SIPRI arms data are problematic, and a reader can also cherry-pick facts from Pinker?s own book that are inconsistent with his position. He notes, for example, that during the 20th century homicide rates failed to decline in both the U.S. and England. He also describes in graphic and disturbing detail the savage way in which chimpanzees?our closest genetic relatives in the animal world?torture and kill their own kind.

Of greater concern is the assumption on which Pinker?s entire case rests: that we look at relative numbers instead of absolute numbers in assessing human violence. But why should we be content with only a relative decrease? By this logic, when we reach a world population of nine billion in 2050, Pinker will conceivably be satisfied if a mere two million people are killed in war that year.

The biggest problem with the book, though, is its overreliance on history, which, like the light on a caboose, shows us only where we are not going. We live in a time when all the rules are being rewritten blindingly fast?when, for example, an increasingly smaller number of people can do increasingly greater damage. Yes, when you move from the Stone Age to modern times, some violence is left behind, but what happens when you put weapons of mass destruction into the hands of modern people who in many ways are still living primitively? What happens when the unprecedented occurs?when a country such as Iran, where women are still waiting for even the slightest glimpse of those better angels, obtains nuclear weapons? Pinker doesn?t say.

Huntsman departure a marginal help to Romney in SC (AP)

COLUMBIA, S.C. ? Republican Jon Huntsman's endorsement of Mitt Romney further cements Romney as the favorite in Saturday's pivotal South Carolina primary, adding another name to the list of party figures calling him best able to beat Democratic President Bararck Obama.

However, it leaves Romney's more conservative rivals still fighting with one another to emerge as his strongest challenger. And it prompted at least one backer of Texas Gov. Rick Perry to urge him to quit the race.

Besides offering Romney his support, Huntsman also appealed for civility in a race that has become defined by attack advertisements paid for by anonymous groups.

"At its core, the Republican Party is a party of ideas, but the current toxic form of our political discourse does not help our cause," he said, as televisions and telephones across the state hummed with attack messages.

Huntsman's endorsement offers little in the way of a campaign organization or bankable support to Romney.

But it does add to the sense of inevitability the former Massachusetts governor has worked to portray in a state that has voted for the eventual GOP since 1980 and where he is campaigning with backing from the state's new Gov. Nikki Haley and Arizona Sen. John McCain, winner of the 2008 primary here.

Romney stands a good chance of winning the votes Huntsman would have received. Both tout business backgrounds and are social moderates in a state where social conservatives are an influential bloc. Polls show Romney was most often the second choice of Huntsman backers.

"Certainly, it will help Gov. Romney here, it's just not clear how much," said former state Attorney General Henry McMaster. An early Huntsman supporter, McMaster had not committed to another candidate after Huntsman's announcement.

But Huntsman's leaves unanswered the overriding question of the Republican campaign: whether voters looking for a candidate more conservative than Romney will unite behind Rick Santorum, Newt Gingrich or Perry and send a strong challenger to compete against Romney in the Florida primary or beyond.

Santorum, a former Pennsylvania senator, dismissed the endorsement during a campaign stop at a Columbia restaurant. "Moderates are backing moderates," he said. "No surprise there."

Gingrich, the former House speaker locked in a bitter battle with Romney, said at an appearance in Myrtle Beach: "Why would you want to nominate the guy who lost to the guy who lost to Obama?"

Gingrich also quickly noted late Sunday, as news of Huntsman's decision broke, that a Greenville businesswoman who had supported the former Utah governor was coming over to Gingrich.

Although Huntsman's departure hardly assures Romney of victory in Saturday's primary, it underscored the tension within the party's conservative wing with just five days left for one of them to emerge.

Santorum was the consensus, if not unanimous, choice of a group of national Christian political activists who met over the weekend in a last-ditch effort to rally conservatives.

"I think it's important that we eventually consolidate this race," Santorum said, stopping short of saying pressure was building on Perry to drop out. "That's up to the candidates themselves to decide."

Polls in South Carolina showed Romney in the lead, followed by Gingrich with Santorum and Texas Rep. Ron Paul fighting for third. Perry trailed in single digits.

A few of Perry's backers have begun calling on him to leave the race.

"There are a lot of conservatives who were happy to see him get in and now who would be happy to see him get out," state Rep. Larry Grooms, an early Perry supporter, told The Associated Press. "When conservatives have split in the past, we end up nominating a moderate, and that's not good for our party."

Conservative author Eric Metaxas indirectly suggested Perry should quit the race while speaking at a packed prayer breakfast in Myrtle Beach on Sunday. The night before he had tweeted: "Dear Gov. Perry: Do the right thing for your country; endorse Rick Santorum before the SC Primary next Saturday...you'll wish you had."

Some South Carolina Republicans still rue McCain's narrow 2008 win over the more socially conservative Mike Huckabee, allowed largely by former Tennessee Sen. Fred Thompson's decision to stay in the race.

Katon Dawson, Perry's South Carolina chairman, resisted the idea that there was a drumbeat for Perry to quit. "I find it sort of offensive that some Republicans would tell us they want to hand pick the candidate before the election," Dawson said.

Ralph Reed, founder of the national Faith and Freedom Coalition, also said he knew of no effort by the conservative leaders who met Saturday in Texas to urge Perry to quit.

"We have never asked any candidate to drop out of the race publicly or privately. And we will not do so," Reed said.

Some evangelical pastors and conservative leaders in Iowa had asked Minnesota Rep. Michele Bachmann to consider ending her campaign to allow a conservative to emerge. She did not, and Romney edged Santorum in Iowa by a razor-thin eight votes.

With Perry showing no signs of departing, Santorum faces the added burden of a barrage of attack ads by an independent super PAC that supports Romney's campaign.

The group, Restore Our Future, was running almost $900,000 worth of advertising this week, more than any of the candidates' campaigns and all of it against Santorum.

Santorum complained Monday about the ads, which accuse him of having supported earmark spending in Congress and supporting voting rights for felons.

Santorum has defended his support for earmark spending. He said Monday he supports allowing felons who have completed their sentences to apply to have their voting rights restored, a policy that is law in 48 states.

Restore Our Future spent roughly $3 million on similar anti-Gingrich ads in the final month of the Iowa campaign and was seen as contributing to his fourth-place finish in the caucuses.

A similar group that supports Gingrich was running roughly $850,000 in ads against Romney.

Some breast cancer spread may be triggered by a protein, study shows

Tuesday, January 17, 2012

Cancers rarely are deadly unless they evolve the ability to grow beyond the tissues in which they first arise. Normally, cells -- even early-stage tumor cells -- are tethered to scaffolding that helps to restrain any destructive tendencies. But scientists from the University of Helsinki, Finland, and from UCSF have identified a cleaver-wielding protein that frees some tumor cells, allowing them to further misbehave.

The protein, they discovered, often blankets the surface of breast tumor cells and can help untether the cells from the matrix of their native tissue. Once released, they may continue to expand their numbers into other tissues where their normal counterparts do not tread.

The protein, called hepsin, is a protease, a class of enzymes that cleaves, or cuts, other proteins. Proteases have been targeted successfully by drugs, and hepsin presents a new possible drug target, the researchers said.

"If we could delay or prevent a tumor from switching from one that grows in place to one that invades, then that would be a major milestone in cancer treatment," said study co-author Zena Werb, PhD, a professor of anatomy at UCSF. Werb has for decades studied the ways in which the behavior of tumor cells is influenced by their surroundings, with a focus on breast tumors.

Working with mouse models of breast development and breast cancer in Werb's UCSF laboratory during a visiting professorship, University of Helsinki scientist Juha Klefstr?m, PhD -- along with Johanna Partanen, a University of Helsinki graduate student -- designed and led experiments that resulted in the discovery of the hepsin protein's role.

Their findings are published in the January 16, 2012 edition of the Proceedings of the American Academy of Sciences (PNAS).

The scientists studied mammary glands in mice and tissue fragments ? called organoids ? isolated from these glands.

They found that inactivation of a tumor suppressor gene known as liver kinase B1 (Lkb1) caused abnormal development of parts of the mammary gland, including milk-secreting structures. Specifically, they determined that a tightly knit matrix of protein fibers called the basement membrane -- which normally surrounds the milk-secreting structures -- was damaged and degraded.

These events may be triggered in many tumors, the team said, as they found that Lkb1 was abnormally missing in 1 out of every 4 human breast cancer samples they looked at.

Most solid tumors arise from "epithelial" cells, which line the surfaces and cavities of organs. The basement membrane, in turn, lines epithelial cell layers in tissues.

In their mouse studies, the researchers quickly settled on hepsin as a suspect in the destruction of the basement membrane that in turn allows tumor cells to become unbound. In the absence of Lkb1, the protein-cleaving enzyme was abnormally spread over the cell surface. They found that deactivating hepsin allowed the basement membrane to recover.

Graduate student Partanen sought to recapitulate the development of cancer by re-engineering the mice, knocking Lkb1 out of normal mammary epithelial cells. Again, hepsin spread abnormally and basement membrane proteins were sliced and diced. After a year, though, she found that the mice had not grown mammary tumors.

"I was disappointed with the results," she said. "However, then I realized that although broken basement membrane may give cells more freedom to proliferate, the cells may just lay there, resting, and not start to over-proliferate unless they are pushed into cycles of cell division."

Partanen then re-engineered the mice so that they also abnormally activated a gene called Myc, which, is known to help initiate tumors in many tissues, including breast epithelium. She soon saw the mice begin to form tumors.

"We found in our study that genetic removal of hepsin from the mammary gland organoids prevents formation of cancerous tissue," Klefstr?m said. "This finding excites us, as it leads us to think that inhibition of hepsin by drug-like molecules could restrain cancer progression.

"However, we do not know yet if we can cure already-formed tumors by blocking hepsin activity. We need to first improve our experimental systems to properly address this question."

According to Web, "We have observed that loss of Lkb1, combined with activation of a weak inducer of breast cancer ? an oncogene such as Myc ? can produce aggressive cancers.

"In humans, breast cancers that have diminished amounts of Lkb1 show strong hepsin expression. Since hepsin sits on the cell membrane, it should be accessible to drugs. We believe that hepsin forms a novel target for treatment of a subset of breast cancer patients."

House Speaker Lujan has lung cancer

SANTA FE, N.M. (AP) - House Speaker Ben Lujan has lung cancer and will not seek re-election this year, the 76-year-old announced Tuesday in a dramatic opening of a 30-day legislative session.

The Santa Fe Democrat, who has been speaker since 2001, made his announcement as shocked lawmakers wept and his wife, Carmen, and son, Democratic Congressman Ben Ray Lujan, looked on.

Lujan said he was diagnosed with cancer in 2009 and has undergone radiation and chemotherapy treatment. He said his cancer is now at stage 4, the most advanced stage of cancer.

"I was hoping to tell you the cancer is gone, but as you can see, it is not," said Lujan, who has served in the House since 1975.

After Lujan made the announcement, lawmakers gave the speaker a standing ovation. Carmen Lujan wept as a long line of lawmaker and well-known political figures gathered to offer their thoughts and prayers to the family.

Ben Lujan was the House's majority whip and majority floor leader before being elected speaker. He succeeded longtime Speaker Raymond Sanchez, who lost his seat in the Legislature in 2000.

"While this has taken a toll on me physically, it has not broken my spirit, my will, my faith and my commitment to New Mexico," said Ben Lujan.

The speaker survived a challenge to his speakership last year when Rep. Joe Cervantes, D-Las Cruces, sought his seat.

Championship pedigree shows for Brady, Eli

The playoffs have a way of bringing out the pedigree in NFL quarterbacks. Simply take a look at the fingers of Tom Brady and Eli Manning to recognize it.

Brady has three Super Bowl rings, with another taken away by Manning and the Giants in 2008. Both have their teams on course for a reprise of that memorable title game.

Standing in their way are two inconsistent QBs seeking to fill out their own championship resumes: Joe Flacco of Baltimore and Alex Smith of San Francisco.

Based on their histories and the way they have performed this season, Brady and Manning overmatch Flacco and Smith. When things have gotten tight for New England or New York, the quarterback often has provided the winning edge.

"The team revolves around him," Patriots tight end Aaron Hernandez said of Brady. "When he comes to play, which he mostly does every game, then we're going to be on fire, and when he's ready, we're all ready."

Ditto for Manning. Even when the Giants hit a four-game slide that jeopardized making the playoffs, he stood out.

"He's just been great," said receiver Victor Cruz, who had a breakout season with Manning throwing to him. "He understands the defense, he understands what we can see on every single down and every single coverage and he's just making the right reads and really hitting people when the time is right."

The time certainly is right. For a decade, it's been Brady time once New Year's Day hits. In early 2008, it also was Manning time.

It is again.

Brady was as good as ever in Saturday's romp past outmanned Denver. His six TD passes tied Steve Young and Daryle Lamonica for the NFL record. His five in one half were the most ever.

Sure, he's got superb targets in All-Pros Wes Welker at wideout and Rob Gronkowski at tight end, plus Hernandez and Deion Branch, who is something of a security blanket for Brady. He also makes them outstanding with his precise passes, leadership and competitiveness.

It rubs off.

"We never look at the individual. We all try and do our job," defensive tackle Vince Wilfork said. "If (Brady) plays well, everyone else plays well. When he has an off day, we try to rally around him as a team to help Tom and the offense. We aren't going to get 20-30 points all the time."

Thirty certainly could be difficult against Baltimore's staunch defense. But 20 might be enough if Flacco doesn't come through.

Something of a surprise first-round draft choice in 2008 out of Delaware, he's helped the Ravens make the playoffs in all four of his NFL seasons. In great part, Flacco has been along for the ride as opposed to driving the vehicle the way Brady does.

He also doesn't have nearly the talent to throw to, with the exception of running back Ray Rice, who led the NFL with 2,068 total yards. His offensive line is spotty.

For Baltimore to reach its first Super Bowl since 2001 ? oh, yeah, the QB then was Trent Dilfer, and Flacco is a far better player than Dilfer was ? some of Brady has to rub off on Flacco.

Smith finally has become comfortable in San Francisco thanks to new coach Jim Harbaugh's guidance and confidence in the seven-year veteran. The 49ers are efficient on offense with a strong running game behind Frank Gore, and a tight end, Vernon Davis, who displayed all his skills in a sensational playoff debut against New Orleans.

To expect Smith to trade throws with Saints star Drew Brees was unthinkable, yet there he was, making clutch pass after clutch pass in the late stages of Saturday's thrilling win. If he's capable of a similar performance against the Giants, it would enhance San Francisco's chances immeasurably.

"He deserves all this," Gore said of Smith's revival. "He's had some tough times. But I always believed he could play at this level. We have the right people leading us. And he's got the right people leading him."

Leading the 49ers to the Super Bowl means beating Manning and the Giants. The Niners did it in November when Smith made just enough key plays. That's been his style this season, a style Manning once adhered to.

Now, Manning is as much a playmaker as his older brother, Peyton, has been. Or as Brady is.

Indeed, another title will give him the championship lead in his family, adding yet another shiny achievement to Eli's resume. But he'd still be behind Brady.

For now, Smith and Flacco can only wonder if they have what it takes to grab the ring.

Lumia 900 set for March release: report

The Lumia 900, Nokia's new Windows Phone, could hit shelves in the US as soon as March, according to one reporter.?

Earlier this month, Nokia took the wraps off the Lumia 900, a smartphone equipped with a 4.3-inch high-resolution display, 512MB of RAM, an 8-megapixel camera, and the Windows Phone?Mango operating system. The new Windows Phone OS has been a hit among reviewers, but the phones that it runs on have so far been rather lukewarm. Nokia hopes to change that with this Lumia line, which has performed consistently well in Europe.?

And according to tech reporter Paul Thurrott, the Lumia 900 could be arriving as soon as March ? earlier than many tech insiders had suspected. Thurrott, who runs the SuperSite for Windows blog, made the comments during a video interview?from the floor of CES, the annual electronics show in Las Vegas.

SEE ALSO: The 10 weirdest uses for a smartphone

The timing would be propitious for Nokia, which could get out in front of the crushing press blitz sure to surround the next iPhone, while sustaining the already?high level?of Lumia buzz.?The Lumia 900, after all, has been called "one of the hottest phones" at CES ? a svelte, a high-powered piece of eye-candy.?

"The Lumia 900 beautifully showcases the Windows Phone OS," Ginny Mies of PC World wrote in a hands-on test of the Lumia this week. "The body is made from a single injectable polyurethane matte plastic build,?as is the Lumia 800, which gives it a sturdy feel. The material is soft to touch, but resistant to scratches (although not necessarily fingerprints). And it doesn't feel like it will completely shatter if you drop it."

Not that everyone is totally blown away. Writing at Ars Technica, Casey Johnston lamented the undersized battery life on the Lumia 900.?

"In our eyes, the biggest red flag, relatively speaking, on the Lumia 900's spec sheet is the battery life: Nokia estimates the phone's 1830mAh battery (a generous size for a smartphone) will get up to 7 hours of 3G talk time and 6.5 hours of video," Johnston notes. "While the phone is undoubtedly faster than other Windows Phone devices we've tried, this suggests that it's operating at too high a level for a decent battery life."?

Hawking too ill to make 70th birthday celebration

CAMBRIDGE, England (AP) ? Renowned physicist Stephen Hawking was too ill to attend a conference in honor of his 70th birthday Sunday, but in a recorded message played to attendees he repeated his call for humans to colonize other worlds.

University of Cambridge Vice Chancellor Leszek Borysiewicz told the conference that Hawking, who is almost completely paralyzed because of Lou Gehrig's disease, had only recently been discharged from the hospital for an unspecified ailment.

"Unfortunately his recovery has not been fast enough for him to be able to be here," Borysiewicz said.

In his recorded speech, Hawking pleaded for interplanetary travel, arguing that humans faced a grim future unless they spread out from their terrestrial home. "I don't think we will survive another thousand years without escaping beyond our fragile planet," he said.

Hawking's speech ? delivered in his distinctive, robotic monotone ? charmed the audience of scientists, students and journalists gathered at Cambridge's Lady Mitchell Hall.

Colleagues including Nobel Prize winner Saul Perlmutter and renowned astronomer Martin Rees hailed Hawking as one of the most important physicists since Albert Einstein.

Borysiewicz said Hawking had "transformed our understanding of space and time, black holes, and the origins of the universe," adding that he hoped that the scientist was watching the proceedings online.

"If you're listening Stephen, happy birthday from all of us here today," Borysiewicz said to a round of applause.

A black hole expert, Hawking is one of the leading lights in theoretical astrophysics. His achievements are all the more remarkable because of his Lou Gehrig's disease, an incurable degenerative disorder with which he was diagnosed as a 21-year-old. Most people die within a few years of the diagnosis, but Hawking has defied the odds and spent half a century carrying out pioneering research.

He owes much of his fame to his best-selling series of works popularizing the latest developments in theoretical astrophysics. "A Brief History of Time," published in 1988, has alone has sold millions of copies. A host of other books, including "A Briefer History of Time," have followed.

Nevertheless the condition ? known as motor neurone disease in the U.K ? has made life difficult. Since catching pneumonia in 1985, he has needed around-the-clock care.

Hawking relies on a computerized wheelchair to move around and a voice synthesizer to speak. His fragile health has forced him to cancel appearances in the past.

Borysiewicz didn't say when Hawking was hospitalized or specify the nature of his condition, but he did say that Hawking would be well enough to meet some of the attendees over the next week.

Despite his absence Sunday, Hawking's celebrity status was evident at Lady Mitchell Hall, where hundreds crowded into the auditorium to hear prominent researchers outline the latest developments in cosmology.

Outside the venue, three teenagers ? self-described "groupies" ? waited in hope of catching a glimpse of the eminent scientist.

Eighteen-year-old engineering student Marianna Sykopetritou said that seeing Hawking would be "a once-in-a-lifetime" experience. She said that the event had a page-and-a-half-long waiting list.

In his recorded message, Hawking said explaining the universe to the wider public was a duty, and that the issue had far more than just theoretical interest.

"If you understand how the universe operates," he said, "you control it in a way."

Chinese, Indian, Turkish Companies Reportedly Interested in Saab?s Assets

It appears that Mahindra may not?be the only one hungry for Saab?s assets. When bidding time comes, it may have to battle a few Chinese automakers and a Turkish company before it can actually bring those Swedish leftovers home.

According to a report by?Automotive News Europe, Dongfeng Motors plans to buy all of Saab?s assets come April, once the Swedish automaker is liquidated. A few years ago, Dongfeng was one of many companies considered to save Saab from bankruptcy. Back then, the Chinese automaker would have gained technology to develop passenger cars and the same rings true now.?Automotive News is also reporting that Youngman Lotus ? which has already purchased Saab?s Phoenix architecture ? is also interesting in scooping additional Saab assets.

If that isn?t enough, the mix is expected to include an unnamed Turkish company, along with Mahindra.?As we reported last month, India?s largest SUV maker is working on a bid to acquire some assets. Mahindra?s plans are still unknown, but the company is allegedl set to meet with Saab?s bankruptcy administrators to work out a potential deal. Needless to say, we are skeptical anything will come to fruition following its failed attempt to bring diesel-powered pickup trucks to America. But if they do walk the walk, it should make for an interesting three-way battle between the Chinese, Turkish and Indian automakers.

Thompson brings tech background to Yahoo (AP)

NEW YORK ? Scott Thompson isn't an obvious pick to lead Yahoo, but he brings to the struggling Internet company expertise in technology and operations.

Whether that's enough will be determined in the coming weeks and months.

Thompson, the head of eBay Inc.'s PayPal online payments business, was named Yahoo's CEO, effective next Monday. He replaces Carol Bartz, who was fired in September after less than three years on the job.

Focused on technology and operations rather than marketing or media, Thompson is "the guy who helps build the clock as opposed to tell the time," said Gil B. Luria, an analyst at Wedbush.

Luria credits Thompson with building PayPal into a "large, fast-growing and predictable payments company."

"When he took over PayPal it was far smaller, much more like an emerging startup that eBay absorbed a couple years earlier," Luria said.

Yahoo will need that kind of growth to emerge from a lengthy financial funk. It has been losing ground to Google Inc. and Facebook in Internet advertising even as that market has expanded in the past few years. Yahoo's stock price has not traded above $20 in more than three years. In that time Google's stock gained 49 percent.

Thompson, 54, will try to turn around the anemic Internet pioneer where others have failed.

If he succeeds, "he will be a hero in Silicon Valley," said Colin Sebastian, an analyst with Baird Equity Research. If he fails? Well, "he'll just be another executive who didn't succeed in turning it around."

Thompson will be Yahoo's fourth CEO in less than five years. Tim Morse, the company's chief financial officer, has been leading the company on an interim basis since Yahoo's board ousted Bartz in September. Bartz got the job in January 2009, replacing co-founder Jerry Yang, whose rocky reign was marked by Yang's refusal to sell the Internet company to Microsoft Corp. for $47.5 billion ? more than twice Yahoo's value today. Yang took over from Terry Semel in June 2007.

Before becoming PayPal's president in 2008, Thompson was its chief technology officer. He joined PayPal after working at Visa, where he was responsible for the development and maintenance of the company's global payments system.

Colin Gillis, an analyst with BGC Partners, called him a technologist and an executive who's had "a good run" at PayPal. That said, Thompson doesn't have media or restructuring skills, which might be expected for someone picked to lead Yahoo.

"We'll see," Gillis said, summing up the sentiment of many Yahoo watchers. "He's certainly going to have an opportunity to prove himself."

Yahoo had stepped outside the Internet industry with Bartz, a former CEO of design and engineering software company Autodesk Inc., and with Semel, who had come from Warner Bros.

Having a leader with a technology and Internet background could help.

Or at least it's something different.

"If you try to determine what makes for a successful Internet company, I think having a strong tech DNA is important," Sebastian said, pointing to the differences between tech-focused Google and media-oriented Yahoo.

"Companies that have more of a marketing foundation can't adapt as quickly," he added. "Competing online is a constantly moving target. You have to have a strong tech foundation to be successful."

Yahoo has been criticized for being slow to adapt to behavioral changes on the Internet. Its email service and sections devoted to general news, sports, finance and entertainment are still popular, but people using those services aren't sticking around as long as they once did.

In social networking, Yahoo has nothing comparable to Facebook or even Google's new Plus service. Its strategy has been to tie its services to Facebook rather than operate its own social-networking destination.

Thompson's leadership style will likely be a contrast to Bartz's. A self-described "straight shooter," Bartz vowed less than an hour after she was hired in 2009 to make sure the company gets some "friggin' breathing room" so it can "kick some butt."

Thompson, meanwhile, is more of a "collegial leader" who manages through consensus.

"Employees of PayPal liked working for him," Sebastian said. "From that perspective, (he's) something Yahoo could use a little bit of now."

US album sales rise for first time since 2004 (AP)

LOS ANGELES ? U.S. album sales rose more than 3 percent last year for the first gain since 2004 ? a sign that rising digital sales are finally stemming the decade-long decline of compact discs.

The uptick to 458 million album sales was helped by the hugely popular sophomore album "21" from British singer Adele, which sold 5.8 million, according to Nielsen SoundScan. Huge interest in Adele also led to the sales of 856,000 copies of "19," her debut album from 2008.

Michael Buble's "Christmas," which was released in late October, racked up 2.5 million album sales. Lady Gaga's "Born This Way" sold 2.1 million, boosted by a massive sale at Amazon.com earlier in the year for a heavily discounted 99 cents.

Digital album sales rose nearly 20 percent to 103 million, while CDs fell nearly 6 percent to 225 million.

The rest of the total is made up largely of digital single tracks, where 10 tracks are counted as one album. Digital singles sales rose nearly 9 percent to 1.27 billion.

The digital sales gains are likely here to stay, said Dave Bakula, senior vice president of analytics at Nielsen. He noted more consumers are using high-end mobile devices, and Google Inc. has launched its online music store, giving it a way to sell music to users of smartphones on its Android platform.

"It shows there's still a lot of growth potential in digital," he said. "That's something I don't see falling down."

Sales of older albums rose nearly 9 percent to 151 million, thanks to heavy discounting, including a Father's Day promotion at some big box retailers and iTunes that touted Journey's greatest hits and the work of other older rock bands.

The Nielsen tally does not include growing subscriptions to all-you-can listen music plans, which have been rising thanks in part to the entry of Swedish service Spotify to the U.S. market in July.

(AP) ? Argentina's president underwent surgery Wednesday to remove her cancerous thyroid gland as supporters waited anxiously outside for word on her condition.

Doctors expected Cristina Fernandez's surgery to be routine and predicted a complete cure without chemotherapy, since preoperative tests showed the cancer had not spread beyond a nodule on the right side of her thyroid gland.

Vice President Amado Boudou was put in charge shortly before the operation, and will remain as the country's constitutional leader for 20 more days while Fernandez takes medical leave, the presidency said.

Fernandez, 58, was found to have papillary thyroid carcinoma shortly after beginning her second four-year term as Argentina's leader last month, her doctors said.

Early Wednesday, Fernandez flew by helicopter from the presidential residence in Olivos to the Hospital Austral in suburban Pilar, north of the capital. She went under general anesthesia several hours later for the operation led by Dr. Pedro Saco, a veteran Argentine oncologist who specializes in cancers of the head and neck.

Experts say thyroid removals are about as routine as cancer surgeries can be, although the process is not without risk: surgeons must take care not to damage a nearby nerve that guides the vocal cords, or to remove the adjacent parathyroids, which regulate the body's calcium supply.

Patients should generally take care to relax their necks after surgery. Temporary hoarseness is common, and in rare cases, permanent voice changes can result. Patients also must swallow radioactive iodide for several days to destroy any cancerous remnants and provide for clearer images to detect any additional cancer, according to the U.S. National Institutes of Health.

After surgery, patients take medicine ? levothyroxine sodium ? for the rest of their lives to replace a hormone that the thyroid glands produce. Blood tests every six to 12 months to measure thyroid levels also are recommended.

The president's doctors didn't say before the operation whether her thyroid would be completely removed, but most thyroid specialists agree that this is the best course, according to Dr. Jennifer Ogilvie, an assistant professor of surgery at New York University who has performed about 1,500 similar operations.

Fernandez's doctors said the tumor had not metastasized or spread beyond the nodule, but Ogilvie said there is no way to know before surgery whether microscopic bits of the cancer have developed elsewhere in the gland. Also, when the entire thyroid is removed, levels of a protein called thyroglobulin should drop to zero, and simple blood tests thereafter can show whether cancer cells that also produce the protein have reappeared.

The president should not have to worry about a scar, Ogilvie said: "Most doctors do very small incisions, which we hide in a skin crease, a little fold in the neck, so it shouldn't show. The scars have gotten a lot better."

And while the plan is for her to remain hospitalized for up to 72 hours, most patients recover quite quickly.

"There's no reason why a patient can't go back to work in a week or two," Ogilvie said. "We don't feel like we're torturing our patients at all by sending them home the next day."

Fernandez is only the latest sitting South American leader to be diagnosed with cancer. Presidents Fernando Lugo of Paraguay, Hugo Chavez of Venezuela and Dilma Rousseff of Brazil all have undergone treatments recently.

Supporters waited anxiously outside the hospital for word on the surgery's results, waving flags, carrying handmade signs that said "Be Strong Cristina" and building small shrines to the populist leader, who won re-election with a 54 percent landslide in October. Many carried pictures showing Fernandez and her late husband, former President Nestor Kirchner, who died of a heart attack in 2010.

Boudou, her former economy minister, is expected to work closely with Fernandez's other Cabinet members while she recuperates at her home in Calafate, in far-southern Argentina, and make no major policy changes. Argentina all but shuts down anyway for the summer holidays in January and February, so her diagnosis and surgery came at a relatively calm time.

NBA: Last unbeatens lose as Heat, Thunder fall

By Agence France-Presse, Updated: Tuesday, January 03, 2012 5:28 AM

Miami and Oklahoma City, the last two undefeated teams in the NBA this season, both lost for the first time on Monday as the reigning champion Dallas Mavericks and Atlanta Hawks celebrated triumphs.

The Mavericks defeated the visiting Thunder 100-87, improving to 2-4 and avenging a loss at Oklahoma City last week, while the hosts Heat fell 100-92 to the Hawks despite a game-high 28 points from Miami's LeBron James.

Miami and Oklahoma City still share the NBA's best record at 5-1 after nine days of a season that was shortened to 66 games per club by a contract dispute between players and team owners.

At Dallas, German star Dirk Nowitzki scored 26 points and grabbed six rebounds to power the Mavericks while Shawn Marion added 17 points, Jason Terry added 15 and Vince Carter contributed 14.

Jason Kidd had a game-high nine assists for Dallas and Ian Mahinmi had a game-high nine rebounds for the Mavericks.

Reigning NBA scoring champion Kevin Durant led the Thunder with 27 points while Russell Westbrook added 18 points and eight rebounds.

At Miami, Joe Johnson scored 21 points and Al Horford added 16 points and nine rebounds to power the Hawks, who improved to 4-1, just behind Miami in the Southeast division.

Tracy McGrady added 16 points, seven rebounds and four assists for Atlanta.

Behind James, the Heat were led by Chris Bosh with 19 points and Dwyane Wade with 12 points and a game-high 10 assists.

Can a borrower be liable for unpaid debt after foreclosure?

Q: I had two properties foreclosed on this year. Although we had short-sale offers on both properties, for some reason the banks would not accept the offers. One of them was my primary residence, which had a first loan of $417,000, and a second in the amount of $180,000. The second home was an investment property, for which the first loan was $290,000 and the second loan was $60,000.

I have some assets, including a commercial building that produces very little income due to the fact that there is a large vacancy within it. Because of the vacancy, my income is less than $10,000 a year.

Will the lender come after me for unpaid debt in regards to the aforementioned foreclosed properties? If so, how will it know whether I have assets or not? Can the lender put a lien on my commercial property?

What are the statutes of limitations for the lenders? Is there anything I can do to get out of this mess aside from declaring bankruptcy?

A: All of your questions are state-specific and depend on the various laws in your state.

For example, in general, the statute of limitations around the country is three years. That means that when three years pass after an event for which you could have been sued over, the courts will not allow such lawsuits to proceed.

The purpose of a statute of limitations is to make sure that if you have a valid claim, you should bring it promptly. Otherwise, witnesses forget facts or die; documents get stale, and it is unfair to file a lawsuit so long after the event took place.

However, state law differs, both with respect to the number of years as well as to the type of incident involved. For example, in many states you cannot file a libel suit after one year.

Additionally, if a document is under seal (with a notary seal or even just the letters LS ? for "legal seal"), many states allow such matters to be brought for a much longer period of time, even up to 12 or more years.

Additionally, state laws differ on whether a lender that has foreclosed can sue the borrower for a deficiency judgment, a situation that could happen if, for example, a borrower owed $250,000 on the mortgage but the lender received only $150,000 from the foreclosure sale, leaving a deficiency of $100,000.

In the District of Columbia where I practice law, a lender can sue for the deficiency.

However, in some 10 states such as Alaska, Arizona, California and Minnesota, laws have been enacted that specifically prohibit a lender from suing for the deficiency.

09:45: Bird flu death in China

A man has died from bird flu in Southern China, it has emerged.

It is the first case of the virus in more than 18 months.

Positive tests on a dead market chicken last week prompted nearby Hong Kong's government to issue an alert.

The island's authorities culled 17,000 chickens after three birds were confirmed to have died from the H5N1 bird flu strain.

It is still not yet clear whether the chickens came from a local farm or if they were imported.

Tebow Was Fined by Teammates for Billboard Telling Coach to Let Him Play

In the final week of the NFL regular season one of the most interesting games will?play out?in Denver as Tim Tebow, the unorthodox Quarterback who has been one of the biggest storylines of the season, will play against his?predecessor Kyle Orton.

Tebow came to the Broncos one year ago following one of the most decorated careers in college football history. As a rookie, Tebow sat out most of last season despite the demands of many fans.?After just one win and four losses this season, the rumbling of Denver fans calling on Coach John Foxx to bench Orton in favor of Tebow grew. On October 5, a billboard went up at an intersection in Denver representing the growing Quarterback controversy:

The sign was put up by three Muslim-American brothers and Broncos fans, who have no have no qualms with Tebow?s well-known devout Christian faith.

?It gives him encouragement, so it?s good,? one brother told the Washington Times. Another: ?That?s where he gets his strength, so he should keep it up because it?s good for Denver.?

Since taking over for Orton on October 9, Tebow has miraculously led the Broncos into playoff contention. Orton was released and picked up by the Kansas City Chiefs. This Sunday Orton comes to Denver as the starting Quarterback with the Chiefs, and has the opportunity to derail the Broncos? playoff hopes.

Coming into the huge game Sunday, the NFL network reports on an?awkward?outstanding debt that the two QBs may need to settle:

?Like many places around the NFL, the Broncos? QBs have an informal system in place that allows them to fine each other for different infractions, whether funny or serious. Late for a meeting? That?s a fine. Say something dumb? That?s a fine, too. Each fine is tallied on a board ? and everyone pays up at the season?s end.

Four days after?a billboard in Denver?on 58th Avenue one block east of Interstate 25 publicly called for coach John Fox to bench Orton in favor of No. 15, the quarterbacks decided to begin fining Tebow every day that it remained up.?

Up to the announcement that he would be the starter, Tebow had been fined daily for not publicly admonishing a sign representing calls from the fans to let him play.

While the debt has gone unpaid, Orton has the chance Sunday to settle the score.

Singer Etta James breathing on her own again (Reuters)

LOS ANGELES (Reuters) ? Soul singer Etta James, who is terminally ill with leukemia, has been taken off a respirator and is breathing on her own again, her friend and manager said on Friday.

Lupe De Leon said the "At Last" singer, 73, is soon expected to leave the intensive care unit of a hospital near her home in Riverside, east of Los Angeles.

"The hospital is preparing Etta for release from ICU to a step down unit. She is stable and breathing on her own. Her blood pressure is normal," De Leon said.

James was admitted to the hospital last week because she was struggling to breathe. She has been in failing health for several years and suffers from leukemia, kidney disease and dementia but had previously been cared for at her Southern California home.

Her live-in doctor said earlier in December that James was considered terminally ill, and that she communicates mostly with nods and simple words. The three-time Grammy Award singer earlier battled obesity and was addicted to heroin for many years.

James was a key figure in the early days of R&B music with hit songs like "The Wallflower" and "Good Rockin' Daddy". But it was her 1961 recording of the ballad "At Last" that put her on the map.
